Exploring Life & Business with Nicole Hernandez of MSC3

Today we’d like to introduce you to Nicole Hernandez.

Hi Nicole, please kick things off for us with an introduction to yourself and your story.
MSC3 was the very first dispensary in Adrian with a loyal customer base since 2010. Now MSC3 is reopened as a boutique Provisioning Center at 717 Division Street, Adrian, Michigan, and will soon be opened for Adult-Use.

Lenewee County Circuit Court ordered a preliminary injunction unsuspending MSC3’s permit allowing the reopening, based upon MSC3 being qualified as a temporary operator, and as such holding a constitutionally protected property interest in their local permit for the marijuana sales location, described by Judge Borello, in his Green Genie v. State of Michigan BMMR injunctive court order applicable to all similarly situated temporary operators. The Michigan Court of Appeals denied leave to appeal; leave is pending in the MSC.

Alright, so let’s dig a little deeper into the story – has it been an easy path overall, and if not, what were the challenges you’ve had to overcome?
It has been a long difficult road because Adrian ignored the Judge Borello Order applicable by its terms to all similarly situated temporary operators. Removal to federal court and the pandemic prolonged the litigation.

We are just very excited to be reopen as we have created a boutique marijuana sales location with unique craft cannabis products for the cannabis connoisseur, as well as a knowledgeable staff to help the newbie.

Thanks – so what else should our readers know about MSC3?
MSC3 is a small family-owned business, owned by long-time cannabis enthusiasts and legalization advocates.

MSC3 is a cannabis connoisseur’s boutique cannabis destination, well worth the drive, to meet the people and buy the best bud around.

MSC3’s knowledgeable staff is customer-focused and will take the time to answer questions and provide responsible guidance for the newbie to start slow and not overdo it.

MSC3 is hip to the cannabis culture, together with its music and other art forms so inspired.

Risk-taking is a topic that people have widely differing views on – we’d love to hear your thoughts.
MSC3 is risk-averse.

MSC3 was one of the only dispensaries that were open back before the MMFLA, that actually complied with the Michigan Supreme Court ruling in McQueen, by hosting private lockers, one per caregiver and his/her patients, who were the only ones with the key.

MSC3 went to the Adrian police and municipal government who praised and approved of her risk-averse approach, the private locker system. A couple others had opened in Adrian by then and were shut down for failing to comply with McQueen but MSC3 was left alone as compliant. Open and honest communication is the best tool for being risk-averse. Owner Nicole Hernandez communicated well since 2010 with the proper authorities and they respected her. Suddenly, when a newbie city attorney showed up, all of that was forgotten and that is when the permit was unconstitutionally suspended, with no prior hearing, ignoring the Judge Borrelo Green Genie ruling. Luckily, she is no longer with the city and we have hope to return to good relations as they had been since 2010.
